REFUND POLICY
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR PLATFORM OR OUR SERVICES.
This Refund Policy (the “Refund Policy”) govern your use of our website at https://fannote.io and any of its subdomains, and any other websites owned and hosted by us (the “Site”), mobile application or online platform (together with “Site”, the “Platform”), as well as any of our products and services offered on or through our Platform (the “Services”). This Refund Policy is incorporated by reference and form a part of our Terms of Service and constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and FanNote, Inc. (“FanNote”, “we” or “us”). IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We may update and amend this Refund Policy from time to time in our discretion, including by adding, deleting or modifying terms. We will alert you about any changes by updating the “Last updated”date of this Refund Policy, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review this Refund Policy to stay informed of updates.
1. Purchases
We are building a platform that enables content Creators to build meaningful and authentic connections and relationships with their Fans. In the Platform, as a Fan, you can engage with and support your favorite Creators by submitting paid questions (“Fan Request”) and receiving personalized responses in text, audio or video format in return (“Creator Content”).
All purchases are final unless specified by this Refund Policy.
2. Refunds
Except for automatic refunds for unfulfilled requests as provided below, FanNote is not obligated to issue any other refunds and may make refund determinations in its sole discretion.
If you made purchases through an app store (e.g., Apple's App Store or Google Play), your purchase may be subject to that store's final payment terms and refund processes. Where required, refunds must be requested through the applicable app store, and FanNote's ability to issue refunds may be limited by the store's rules.
a. Content Concerns
Once a Creator has delivered their Creator Content in response to a Fan Request, the Fan Request is considered completed and non-refundable.
If a Fan believes that a Creator Content is materially inadequate based on the submitted Fan Request, the Fan may flag the Creator Content for administrative review as provided in the Terms. However, this does not create a right to a refund. Disagreement with a Creator's opinion, delivery style, tone, or subjective quality does not constitute grounds for a refund. FanNote will only issue a refund or credit if FanNote determines, in its sole discretion, that the purchased Creator Content fails to address the Fan Request or otherwise violates the Terms, other additional terms, or applicable laws and regulations.
b. Unfulfilled Requests
The response window, i.e., the deadline by which Creator Content must be provided in response to a Fan Request, will be disclosed to the Fan prior to completion of the purchase. If no response window is designated or configured for the applicable Creator, the response window will default to seven (7) calendar days from completion of the purchase. If a Creator fails to deliver the Creator Content within the applicable response window, the transaction will be automatically cancelled, and the Fan will receive a full refund to the original payment method used, without need for further action.
Note that if you are a Fan, the automatic refund may be delayed by your payment processor or your payment method provider due to issues outside of our control, and you may not see a credit to your payment method right away. FanNote is not responsible for any such delays.
Once the refund has been issued, the Fan Request is considered closed and may not be fulfilled unless it is resubmitted as a new Fan Request.
c. Technical Errors
Fans may also request for a refund in the following circumstances:
- Duplicate charges;
- Platform or payment processing errors;
- Failed or incomplete transactions.
You may raise a refund request through the FanNote support channel by emailing info@fannote.io or through any in-app support functionality made available by FanNote. Refund requests should include sufficient information for review, including the email address associated with the FanNote account, the applicable Creator name, date of purchase, and brief description of the issue.
All refund determinations under this subsection are made at FanNote's sole discretion. FanNote is not obligated to issue any refunds for technical errors made by you.
d. Cancelled Requests
FanNote may, in our sole discretion, limit or cancel the amount of Fan Requests made per person, per household, or per order. We reserve the right to limit or prohibit a Fan Request that, in our sole discretion, appears to be made in violation of these Terms, any additional applicable terms, or applicable laws and regulations.
3. Chargebacks and Payment Disputes
Fans agree to contact FanNote by emailing info@fannote.io prior to initiating any chargeback or payment dispute through their payment method providers. Initiating a chargeback on your payment method before raising it with FanNote may delay resolution and may result in suspension or termination of your Account. FanNote and/or its payment processors may request additional information for any investigation and response to your dispute. You agree to provide such information promptly to facilitate timely resolution of your dispute.
If you initiate a chargeback or payment dispute with your payment method provider, they will determine outcomes in accordance with their terms and applicable network rules.
4. Jurisdiction
This Refund Policy is intended to apply globally, but rights may vary by location. Nothing in this Refund Policy limits any rights you may have under applicable laws that cannot be waived.
